The undersigned notes that the above-captioned property abuts United States Route 119 to the north. Route 119 was partially created by a grant of land of record in Deed Book 127, at Page 230. In that instrument, the grantors conveyed unto the West Virginia Department of Highways real property to be used in connection with “the construction, maintenance and use of a controlled access facility (freeway).” The grant also includes a clause indicating that the creation of this roadway has “no rights of access to said facility by abutting owners.” Based on the language contained in the grantor from prior owners, the undersigned notes that the above-captioned property does not have direct private drive access to the public roadway. Accordingly, it is recommended that you obtain any and all necessary administrative approvals by the West Virginia Department of Highways to access Route 119 and obtain driveway access to the above-captioned property.
